Who Qualifies
Oregon Expungement Eligibility
In Oregon, most misdemeanors, Class C felonies, and non-person crime Class B felonies are eligible for expungement. Dismissals and acquittals can often be expunged with no waiting period at all — even if you were never convicted, that arrest may still appear on background checks.
The table to the right shows how long you must wait before applying, depending on your case type. Wait times run from the date of conviction or release from imprisonment, whichever is later.
What Is Not Eligible?
- Traffic crimes of any kind
- Violent felonies and Measure 11 offenses
- Sex crimes and offenses requiring registration
- Most offenses involving child abuse
- Class A felonies (with limited exceptions)

Why It Matters
Your Record Is Holding You Back
A criminal record — even for a minor offense — can silently close doors you don’t even know are being shut. Clearing your record removes that barrier. Many clients report being offered jobs, approved for housing, or granted professional licenses shortly after their expungement is finalized.
Employment
Oregon employers routinely run background checks. An old arrest or conviction can disqualify you from jobs you’re otherwise perfectly qualified for — before you even get an interview.
Housing
Landlords screen applicants before approving leases. Many automatically reject applicants with criminal records, limiting your housing options and where you can live.
Professional Licenses
Licensing boards for nursing, teaching, contracting, real estate, and dozens of other fields consider criminal history. Expungement can remove that barrier to your career.
Peace of Mind
Once your record is expunged, Oregon law allows you to legally state you were not arrested, charged, or convicted of the expunged offense in most situations — giving you a genuine fresh start.
How It Works
The Oregon Expungement Process
Expungement is not automatic — you must file a motion with the court in the county where your case was heard, notify the District Attorney’s office, and navigate potential objections. Casey handles all of it.
Free Consultation
Call or email Casey to review your record and confirm your eligibility. There is no charge for this initial review.
Petition Filed
Casey prepares and files the expungement motion with the correct court in the county where your case was heard, and serves the District Attorney.
Record Cleared
Once the court grants the order, your record is sealed and no longer appears in standard background checks used by employers and landlords.
Common Questions
Frequently Asked Questions
Can I expunge a felony in Oregon?
Yes. Certain felony convictions — including most Class C felonies and some Class B felonies involving non-person crimes — are eligible for expungement after the required waiting period. Not all felonies qualify, which is why speaking with an attorney is important.
Will my expunged record show up on a background check?
Once an Oregon court grants your expungement, the record is sealed and will not appear in standard commercial background checks used by most employers and landlords.
What if my case was dismissed or I was acquitted?
Dismissals and acquittals can often be expunged with no waiting period. Even if you were never convicted, an arrest record can appear on background checks and harm your reputation and opportunities.
Do I need a lawyer to file for expungement?
You are not required to have an attorney, but mistakes in the petition — wrong forms, missing documentation, or failure to properly notify the D.A. — can result in denial. An attorney ensures the process is done right and represents you if the District Attorney objects.
What does expungement cost?
Casey charges $700 to expunge a prior arrest that did not result in conviction. The cost for expunging a conviction is $950, which includes the $33 Oregon State Police background check fee..
How long does the expungement process take?
Timelines vary by county and caseload, but most expungements are completed within a few months of filing. Casey will give you a realistic timeline based on your specific county and circumstances.
