Expungement is a process of clearing your record of a conviction, dismissed charge, or record of arrest. In Oregon, there are specific requirements that must be met. Once a judge signs the Order to Set Aside, it is as if the arrest and/or conviction never occurred in the eyes of the law. How long after my conviction do I have to wait before I can get it expunged?
The waiting time depends on the category of crime and is calculated starting on the date of conviction. The times are as follows: B Felony: 7 years, C felony: 5 years, A misdemeanor: 3 years, B or C misdemeanor, violation, or contempt conviction: 1 year.
*Please note that in Oregon you cannot expunge a conviction for a traffic offense such as DUI, Reckless Driving, or Hit and Run.
How much does an expungement cost?
My fee for an expungement of a prior conviction is $800. My fee to expunge a prior arrest is $700. If a hearing is required (which is unusual), and additional fee may be owed. If multiple prior cases are involved, The Law Office of Casey Kovacic will offer a reduced package rate.
How long does the expungement process take?
It varies by Oregon county, but typically takes between 6 and 9 months from the filing of the paperwork to the judge singing the order.
I no longer live in the area; do I have to travel to your office or court?
No, in almost all cases, the expungement process can be handled remotely.

First, you must ask the court to reduce your conviction under ORS 137.222 to a misdemeanor. Once that happens, you can ask the court to clear the conviction from your record completely.
